Florida pool regulation snapshot
Florida splits public pools between the Department of Health (operating permits, water quality, supervision under F.S. ch. 514 and F.A.C. 64E-9) and local building departments (construction under Florida Building Code, Building, Chapter 454). Residential pools are governed by the statewide Florida Building Code (8th ed. 2023; 9th ed. 2026 effective Dec. 31, 2026) and the Residential Swimming Pool Safety Act (F.S. ch. 515). Pool construction requires a state-certified or registered pool/spa contractor under F.S. ch. 489.
Health and operating oversight
Regulator: Florida DOH, Division of Environmental Health — public swimming pool program, administered through county health departments (CHDs), which issue operating permits and inspect. Local building departments issue construction permits and enforce FBC Ch. 454.
Building-code path
Building code: Statewide Florida Building Code, 8th Edition (2023) — FBC-Residential Chapter 45 (private swimming pools; barrier at R4501.17). 9th Edition (2026), based on 2024 I-codes, 2023 NEC and 2024 IECC, takes effect Dec. 31, 2026. (FBC does not use the ISPSC.)
State-level starting point
State barrier / drowning-prevention law — F.S. ch. 515 (Residential Swimming Pool Safety Act): New residential pools (water >24 in deep) must have at least one of: (1) barrier per §515.29 — ≥4 ft high outside, no gaps to crawl under/squeeze through, outward-opening self-closing self-latching gates with pool-side release, placed away from water's edge; (2) ASTM F1346-91 safety cover; (3) exit alarms on doors/windows (85 dB at 10 ft); (4) self-closing, self-latching doors with release ≥54 in; (5) ASTM F2208 pool alarm. Violation: 2nd-degree misdemeanor, waived if feature installed within 45 days and owner attends drowning-prevention program. Contractors must give buyers the requirements and drowning-prevention info. Local ordinances equal/stricter are exempted (§515.37). Bills to extend requirements to resales (HB 93 2025; SB 244/HB 117 2026) and vacation rentals (HB 79 2026) died.

FORT MYERS, FL POOL BUILDER FAQ
Questions before you hire
How do I research Pool Builders in Fort Myers, FL?
Use the Pool Builders shown here to form an initial longlist. Then confirm service area, legal identity, required credentials, current insurance evidence, comparable work, references, and a complete written proposal directly.
How should I verify a Pool Builder in Fort Myers, FL?
Match the legal name on the proposal to official business and licensing sources where applicable. Confirm the responsible people, insurance evidence, permit roles, recent comparable work, references, and warranty provider.
Who handles pool permits in Fort Myers, FL?
Florida splits public pools between the Department of Health (operating permits, water quality, supervision under F.S. ch. 514 and F.A.C. 64E-9) and local building departments (construction under Florida Building Code, Building, Chapter 454). Residential pools are governed by the statewide Florida Building Code (8th ed. 2023; 9th ed. 2026 effective Dec. 31, 2026) and the Residential Swimming Pool Safety Act (F.S. ch. 515). Pool construction requires a state-certified or registered pool/spa contractor under F.S. ch. 489. Use the cited state research as a starting point, then confirm current requirements with the building, zoning, health, utility, and trade authorities responsible for the project address.
What site conditions should a proposal for Fort Myers, FL address?
The proposal should respond to the actual survey, access, utilities, easements, grade, drainage, soil or groundwater information, neighboring property, barriers, and restoration needs. Use the Fort Myers, FL planning priorities above as interview prompts.
What should a pool construction proposal include?
A useful proposal defines design, approvals, access, excavation, structure, plumbing, electrical work, equipment, finishes, decking, drainage, barriers, cleanup, allowances, exclusions, owner work, schedule assumptions, and closeout deliverables.
Should I choose the lowest pool proposal?
Compare proposals only after normalizing scope and responsibility. A lower price can reflect a different specification, missing work, larger allowances, or risks left to the owner.
What can delay a pool project in Fort Myers, FL?
Design decisions, surveys, engineering, authority review, utility coordination, access preparation, weather, inspections, owner changes, concealed conditions, materials, and subcontractor sequencing can all affect progress. Ask for dependencies and recovery steps, not only a completion date.
